Legal and Compliance Practitioner [Ref. 1930/17]

Salary: R 698 169.00 per annum (Total Cost to Company)

Job Purpose: The Legal and Compliance Practitioner is responsible for ensuring that the organisation complies with the
regulatory and legislative requirements and that the organisation’s operations comply with internal standards. Ensure that
all legal and compliance risks are managed, and that legal and compliance issues and processes are monitored and
reported. The successful applicant will be based at the ETDP SETA Head Office in Johannesburg and report to the Manager:
Corporate Servies.

Minimum Requirements

  • A Bachelor of Law Degree, LLB or B. PROC (NQF Level 7)
  • Completed articles within the legal environment will be advantageous
  • A membership with the Compliance Institute of South Africa or any Legal Institute will be an added advantage
  • A minimum of five (5) working experience in a legal environment in contract management, litigation and/or regulatory
    compliance experience.
  • Experience in developing and managing compliance monitoring programmes
  • Proven experience in coordinating compliance issues at an organisational level
  • Strong contract drafting skills on commercial agreements (contract management)
  • In-depth knowledge of applicable Compliance and Risk standards and management
  • Sound analysis and interpretation of laws and regulations knowledge
  • Computer literacy (MS Office packages) and an ability to work with data
  • A valid certified driver’s licence is essential.

Knowledge, Attributes and Skills Required

  • Understanding and knowledge of regulations and legislation pertaining directly/indirectly to commercial contracts

Duties and Responsibilities

  • Draft standard template of ETDP SETA Agreements (inter alia service provider agreements, suretyship agreements,
    SLAs, MOUs, MOAs, etc.)
  • Negotiate contracts with relevant institutions and draft legal letters
  • Oversee the drafting and vetting of contracts, legal matters/instruments and compliance processes within the ETDP
    SETA
  • Peruse agreements/contracts and provide opinions on the organisation’s acceptability and appropriateness (valid and
    legally binding)
  • Draft and/or review leases, service level agreements, and all agreements attached to the ETDP SETA buildings
  • Facilitate the signing of legal agreements and explaining content to non-legal employees
  • Resolve legal disputes by conducting thorough research into relevant legal issues
  • Draft legal and policy documents and amend same when required
  • Attend all legal correspondence, e.g., letters of demand, summons, and all court processes received and to all legalrelated matters for the organisation promptly, professionally and efficiently
  • Follow the organisation’s approved procurement policy and establish a panel of attorneys for the company
  • Liaise with external attorneys and advisors on specialised areas of law and prepare comprehensive briefs to counsel,
    where required
  • Consult and advise stakeholders on resolution of legal matters and the interpretation of the law
  • Prepare reports for senior management within the organisation
  • Drive the compliance risk assessment in analysing the compliance risks and identifying, describing and estimating the
    compliance risks affecting the organisation
  • Consolidate the compliance universe and monitor compliance in this regard
  • Develop and manage compliance programs to minimise instances of non-compliance
  • Monitor compliance with legislation, rules, codes, standards, policies, and procedures within relevant areas and report
    non-compliance issues to the Line Manager periodically
  • Ensure the promotion and assessment of the current state of compliance across the organisation
  • Develop and implement organisation compliance profiles
  • Participate in implementing compliance risk action plans and participate in special or ad-hoc strategic risk assessments
    or projects
  • Provide support for developing, initiating, maintaining, and revising policies and procedures for the general operation
    of the organisation and related activities to prevent risky conduct
  • Maintain compliance risk management plans of the ETDP SETA and oversee the maintenance of the relevant plans for
    accurate record keeping and tracking the recording of actions for improving compliance status
  • Report compliance status in the management reports and to the Line Manager, Risk Management Committee and
    other structures as and when required
  • Provide advice to the relevant department in terms of compliance issues identified in the respective areas
  • Facilitate compliance management training closely with HR and other relevant stakeholders
  • Research best practices in corporate governance to adopt and align them with the organisation’s compliance practices
  • Compile monthly compliance reports for the various stakeholders
  • Any other duties as assigned by the Line Manager.

Supply Chain Management Specialist [Ref. 1930/16]

Salary: R 1 045 456.00 per annum (Total Cost to Company)

Job Purpose: The SCM Specialist will develop and maintain the supply chain management system and oversee the overall
supply chain management operations, including demand, acquisition, logistics, disposal, performance, and risk
management. The incumbent will also review the supply chain management performance and make recommendations to
improve the efficiency and effectiveness of the supply chain. The successful applicant will be based in ETDP SETA Offices in
Johannesburg and will report to the SCM Manager.

Minimum Requirements

  • A Bachelor’s Degree (NQF 7) in Supply Chain Management or Logistics or Procurement
  • A postgraduate degree (NQF 8) in Supply Chain Management or Logistics or Procurement would be an added
    advantage
  • A professional membership with CIPS would be an added advantage
  • Minimum of five (5) years relevant experience in an SCM environment, of which three (3) years must be at middle
    management level in the Public Sector environment
  • Knowledge and understanding of Supply Chain Management, internal controls, budgeting, and internal and external
    audit processes
  • Extension experience in contract management, financial analysis and procurement process
  • In-depth knowledge of regulatory frameworks such as PFMA, National Treasury Regulations, PPPFA, PPR, B-BBEE Act
    and Supply Chain Management Framework and other legislation impacting the organisation compliance requirements
  • Extensive experience in logistical support, market research, preferential procurement, and Bid committee processes
    and practices
  • Advanced computer skills (Microsoft Packages) with high written and verbal communication skills

  • Manage the compilation of the demand management and procurement plans for the ETDP SETA
  • Review the request for procurement by ensuring that it is on the ETDP SETA Annual Procurement plan and that there
    is an approved budget
  • Oversee the implementation of the supply chain management systems, including Demand, Acquisition, and Logistic
    Management
  • Oversee procurement of goods and services, assets, resources acquisition and optimisation in the organisation
  • Identify preference points system and appropriate goals per commodity in terms of preferential procurement policy
    and objective
  • Oversee that an effective bid/quotation process is implemented and maintained in accordance with the ETDP SETA
    policies and procedures and compliant with applicable legislative requirements
  • Coordinate the placement of the advert and all required documents on the ETDP SETA website, Government Gazette
    and relevant media
  • Coordinate the bid briefing session when required
  • Establish guidance in the implementation of the ETDP SETA sourcing strategy
  • Manage the ETDP SETA Prospective Provider Database
  • Participate and provide appropriate support and advice to the Bid Specification and/or Evaluation Committee
  • Formulate and monitor SCM policy implementation and reforms in the SCM environment
  • Conduct reference and compliance checks on the recommended providers by the BEC
  • Report on supply chain management information as required to internal and external stakeholders and liaise with
    internal and external stakeholders
  • Develop and oversee the implementation of the SCM performance system
  • Manage queries related to the bid processes, including placing the summary of queries on the website
  • Compile and maintain the monthly and quarterly reports in compliance with the National Treasury and DHET reports
  • Oversees the Audit processes by providing documents to the Auditor Generals and internal auditors during the audit
    trail
  • Manage the SCM Unit and the performance management system

Provincial Skills Advisors X3

Eastern Cape (2 Posts) [Ref. 1930/18] | Limpopo (1 Post) [Ref. 1930/19]
Salary: R 698 169.00 per annum (Total Cost to Company)

Job Purpose: The Provincial Skills Advisors will coordinate and facilitate skills development programmes and projects in the
province of their appointment. The successful candidates will manage, implement and coordinate all assigned provincial
skills development initiatives, such as learnerships, skills programmes, internships, bursaries, workplace-based learning
agreements, support for small/micro levy-paying organisations, and communication of scarce and critical skills in the
province.

In addition, he/ she will liaise with internal and external stakeholders concerning all aspects of skills development
coordinated by the ETDP SETA, including monitoring implemented programmes in line with the stipulated requirements.
The successful applicants will report to the Provincial Managers in their respective provinces and the positions are based at
the ETDP SETA Provincial Offices in East London (Eastern Cape) and Polokwane (Limpopo).

Minimum Requirements

  • A Bachelor’s Degree (NQF Level 7) in Education, Training, and Development / Public Administration / Business
    Administration / Business Management/ Bachelor of Project Management
  • A certificate or diploma in Project Management would be advantageous if a Bachelor’s Degree does not include this
    Project Management
  • At least five (5) years experience in skills development processes within the ETD sector, with three years of working
    experience in a Project Management implementation environment
  • Experience in project management methodologies, tools, and techniques is essential. This includes Extensive
    knowledge and experience in the project lifecycle, planning, scheduling, budgeting, risk management, administration
    system operations, project financial management and quality assurance
  • Knowledge and understanding of the Sector Education and Training Authority (SETA) environment
  • Sound knowledge and experience in stakeholder relations management with good negotiation skills in the
    coordination of services
  • Proven experience in coordinating, implementing, monitoring and evaluating projects/programmes
  • Knowledge of document management systems for organising and maintaining project documentation
  • Good understanding and extensive knowledge of applicable policies, legislation, guidelines, standards, and procedures
    in skills development, including the Skills Development Act (SDA), Skills Development Levies Act (SDLA), Discretionary

  • Develop and maintain project plans, timelines, and budgets in collaboration with the provincial operational plan
  • Manage and implement the ETDP SETA provincial programmes and projects within the allocated targets and budgets
  • Coordinate project activities, ensuring alignment with project objectives and milestones
  • Develop a project monitoring and evaluation plan and tools and evaluate projects continuously against provincial
    annual plans and deliverables
  • Implement quality improvement initiatives to enhance project delivery processes
  • Monitor the implementation of identified learning programmes and conduct site visits
  • Proactively address issues and challenges that arise during project execution
  • Monitor the contracted skills development providers, learners and workplaces and prepare verification audits
  • Recruit prospective skills development providers to embark on the accreditation process and encourage those who are
    already accredited to have their scope extended
  • Recruit prospective constituent employers and learners
  • Prepare, develop and manage the contracts relevant to each project and manage the project’s deliverables
  • Manage all project-related conflicts and build strong relationships with skills development providers and stakeholders
    within the ETD sector to foster collaboration and support project success
  • Collation and processing of documents relating to payments
  • Manage and monitor learners’ payments through payroll administration and ensure that skills development provider
    payments are made on time
  • Process and manage learners on the MIS system and their respective databases
  • Effectively communicating the ETDP SETA skills development initiatives, ensuring that constituencies and stakeholders
    are engaged in what should be done to achieve the sector skills development and strategic priorities, and marketing all
    the ETDP SETA services, programmes, and projects
  • Conduct advocacy and outreach programmes
  • Distribute marketing materials and attendance of exhibitions and skills development-related events in the province
  • Plan and implement capacity-building programmes in the province
  • Undertake project reporting on the completion of projects to be linked to impact analysis
  • Provide monthly and quarterly progress reports and verifiable evidence supporting all reported achievements as
    required
  • Provide regular feedback to the Provincial Manager regarding the operational responsibilities and outputs
  • Any other ad hoc duties as assigned by the Provincial Manager as and when needed.

NOTE:

  • The positions will be based in the ETDP SETA East London or Polokwane offices. Extensive traveling will be required.
    Hence, a valid driver’s licence is a prerequisite.
