The Compliance and Risk Manager will mainly be responsible for ensuring that COO processes are in compliance with Legislation and Rand Water Policies and procedures. The incumbent would need to assume responsibility for identification, assessment, monitoring and reporting of compliance and establishing systems and processes to ensure compliance with all legislative and regulatory requirements impacting on the Rand Water’s Bulk Water Distribution Services.
Minimum Requirements
4 years’ relevant tertiary qualification in either Commercial Studies, Regulatory compliance, Legal studies.
Master’s Degree is an added advantage
7 + years’ experience in Legal or Compliance management or related functions
Proven experience and good working knowledge of regulatory compliance management processes and techniques, including identifying, creating, establishing and maintaining a regulatory universe, implementing of risk management plans, creating a monitoring program, drafting of policies, implementing and performing compliance training is a necessity;
Primary Duties
Identifying, establishing and maintaining the COO regulatory universe (and how it impacts other regulations), assist with the drafting of risk management plans and assist business with the implementation of such plans;
Taking primary responsibility for design of and implementing of systems and controls to ensure compliance with all relevant legislation and regulations impacting on Rand Water;
Developing action plans to respond to regulatory changes and to address shortfalls in compliance;
Liaise with executive management and shareholder via the relevant established governance structure with regards to the Portfolio’s and sustainability.
Promote a compliance culture within the COO Portfolio.
Draft Compliance Risk Control Assessments for all legislation on the Regulatory Universe
Drafting Regulatory Report and conduct legal and impact analysis of new legislation
Collaborate with line management to advice and enhance facilitation of discharging responsibilities in order to:
o Protect the Portfolio’s reputation from potential non-compliance sanctions and penalties
o Avoid legal actions
o Promote a coordinated working relationship with business regulators
o Prevent unethical, illegal or improper conduct
o Promote the use of the compliance hotline
o Promote awareness campaigns and road shows in order to enhance understanding of new and existing compliance requirements
Knowledge
Proven knowledge of government legislation (The Constitution, Acts and National Treasury regulations), audit regulations, legal obligations.
Strong commercial awareness.
