LITIGATION ADMINISTRATOR

Job Purpose: To administer and process the files referred by the Arbitration section
in order to contribute to the smooth and efficient conduct of litigation, within legal
time frames and avoid debt prescription.

Job Objectives:

  • Administration and processing of case files and litigation documents within the
    stipulated timeframes for those who haven’t complied with the arbitration
    orders.
  • Prepare and Administer section 143 applications and writs of executions.
  • Liaise and Administer section 143 documents in conjunction with the CCMA or
    Labour court, where applicable.
  • Referring writs of execution that are signed to the Sheriff’s office for execution
    of cases.
  • Monitor and administer Sheriffs returns or communication to ensure efficient
    execution of writs and turn around times to finalize the cases.
  • Liaise with attorneys/ labour consultants and employers explaining the
    procedure to settle claims and provide summary of all outstanding cases upon
    request.
  • Providing an effective and efficient service to walk in clients on progress of their
    cases that are at the litigation department.
  • Providing documents to Funds Administration for processing of payments.
  • Ensuring that all correspondence is timeously attended to.
  • Keep statistics and records of all cases still in progress at various levels of
    litigation.
  • Ensuring that all the cases that have been finalized and closed are
    systematically filed working with Document Management administration.
  • Prepare and submit monthly stats report to the immediate Supervisor on all
    activities, challenges, and cases for the month.
  • General Office Administration including stationary control and filing.
  • Manage allocated resources efficiently.

REGISTERED CLINIC NURSE

Job Purpose:
To provide primary nursing care, monitor health conditions, plan long-term care needs,
administer medicine, use medical equipment, perform minor medical operations, and
advise patients on illness, care and continued care.

Job Objectives:

  • Provide educational or advisory role, making presentations to groups, and/ or
    working in Wellness Centres.
  • Provide administrative support by maintaining proper system and processes for the
    control and supply of medicines
  • Assess a patient’s health, as well as detect changes in symptoms, health or pain,
    and will need to know when action is necessary.
  • Be sympathetic to a patient’s needs, and be able to deal with people in various
    states of pain, trauma and tragedy.
  • Giving care and counselling under stressful circumstances requires patience
  • Educate and distribute pamphlets to sensitise Truck Drivers on the importance and
    availability of the primary health care service
  • Ensure patient records are opened and properly stored for easy retrieval
  • Give instructions and guidance to Wellness Centre Coordinators
  • Ensure that the Clinics are kept clean and that maintenance is done when and
    where necessary
  • Identify risk management issues related to Clinics and set in place measures to
    mitigate the risk

Required Knowledge:

  • Knowledge and experience to educate and advise patients on stages of health and
    risks
  • Must have own reliable transport due to awkward hours of work dictated by clinic

    everyone calm and help them understand the situation.

▪ Dispensing Certificate will be advantageous

AGENT

Job Purpose:
Is to ensure that all companies falling in the Council scope of registration are registered
and compliant with all agreements of the NBCRFLI that are promulgated by the
Minister of Labour in terms of the LRA.

Job Objectives:

  • Promote, monitor and enforce compliance with all Collective Agreements by
    investigating and searching, determining jurisdiction for companies that are
    operating in the registered scope of the Council, registering or opening cases
    where companies refuse to register.
  • Interpretation of all clauses of the Main Collective Agreements in order to enforce
    all Council Agreements and issue Compliance Orders to companies that are non
    compliant.
  • Calculate and determine the amounts owing to Council as a result of noncompliance, conciliate disputes on non-compliance and issue a certificate of
    outcomes if dispute is unresolved for case to be referred to Arbitration for
    independent Commissioner to Arbitrate.
  • Conduct full inspection i.e. full inspection, logbook inspection, educational
    inspection and demarcation disputes inspection in loco and issue findings report.
  • Discuss and explain inspection reports with stakeholders in order to avoid future
    non-compliance.
  • Receive complainant cases to Investigate for enforcement, decide on appropriate
    form of investigation to be undertaken and ensure quality case investigations
    within prescribed period
  • Attend to enquiries and requests related to the role and purpose of the Council and
    other matters related to the collective agreements and applicable legislation
  • Lead Enforcement cases already referred to Arbitration and ensure successful
    Prosecution of cases during arbitration
  • Serving of circulars and marketing material to stakeholders during company visits
    and ensuring that all stakeholders regard the NBCRFLI as a valuable partner
  • Prepare and submit weekly activity reports.
  • Planning and organising of daily, weekly and monthly enforcement activities.
  • Perform perception surveys with Stakeholders.
  • Negotiate, Drafting and signing of settlement agreement with employer
    representatives and submit such agreement to commissioners for approval as an
    Arbitration award.
  • Cost centre management and control of cost items related to the function.
  • Resolve all unresolved queries and problems from Fund Admin, Dispute,
    Arbitration, Litigation, Client Services, Returns Control & Membership Department
    related to allocated companies with employer representatives
  • Execute (Serve to companies) legal documents such as compliance orders, notice
    of arbitration, writ of execution, membership queries and awards
  • Training and Educating Industry HR Practitioners and employees in relation to
    Council online system and application and or provisions of Agreements.
  • Scrutinize all electronically generated exception reports, check, investigate and
    issue manual Compliance orders were necessary and report appropriate actions
    where relevant.
  • Address mass employee gatherings on Agreement and compliance related issues.
  • Building stakeholder relationships with company and employee representatives
    and at all times conducting oneself in an objective and fair manner.
  • Being a Custodian of the NBCRFLI image and reputation, conduct oneself in a
    manner which will promote aforesaid. (We are in agreement with the proposals).

ENFORCEMENT ARBITRATIONS & RETURNS CONTROL OFFICER

Job Purpose: The purpose of the position is to provide an end all-inclusive support
services for Enforcement Arbitrations scheduling, processing for non-payments,
referrals for arbitration cases, reporting, utilisation of commissioner dates,
administration of commissioner claims and invoices and updating of council telnet
system.

Job Objectives:

  1. Ensuring arbitrations are allocated within the statutory time frames and
    attaching dates and commissioners to arbitrations.
  2. Ensuring that all parties concerned are properly and timeously notified of
    arbitrations and that all the necessary documentation has been prepared.
  3. Ensure that all commissioners contact details are up to date, that they are
    scheduled effectively and that they are paid on time for services rendered.
  4. Ensure that all arbitration related correspondence is attended to within the
    prescribed timeframes and that faxes and e-mails are distributed effectively
    on a daily basis.
  5. Close files and ensure proper filing of cases that has been closed.
  6. Provide monthly statistics and reports on enforcements and arbitrations to the
    Supervisor.

Requirements Knowledge:
