SENIOR INVESTIGATOR – CRYPTO ANALYSIS ENFORCEMENT SUPPORT UNIT (Pretoria)

Purpose of the Job:

To conduct and guide forensic investigations in crypto-related inquiries, overseeing necessary tasks, analyzing transaction data within the financial services industry (financial markets, insurance, collective investment schemes, hedge funds, pension funds and financial and advisory services) and to take responsibility for the regulatory and enforcement action, following from such investigations. The person appointed to this position will report to the Senior Manager.


Key Performance Areas:

• Develop and execute a precise and efficient investigation plan for the crypto inquiry, providing support to the investigation team.
• Conduct intricate data analysis and deliver comprehensive reports on findings (gathering all relevant, admissible evidence and proper analysis of the   evidence).
• Take responsibility for the execution of all enforcement actions, including the drafting of all enforcement documentation presentation to enforcement   meetings.
• Provide external stakeholders with training and guidance on compliance matters related to cryptocurrency regulations.
• Ensure compliance with protocols and procedures, including confidentiality and non-abuse of investigation powers.
• Identify and implement methods to improve efficiency and quality.
• Collaborate with other investigative teams to integrate data analysis insights into broader investigative strategies and decision-making processes.
• Monitor and interpret evolving laws, regulations, and industry standards in the cryptocurrency space, producing comprehensive compliance policies and   procedures documentation.

Requirements

A bachelor’s degree in finance, accounting, and or computer science, including 3 certificate courses that are SANS (SysAdmin, Audit, Network, and Security) recognized. With minimum of 5 years’ experience in the crypto asset industry including exposure to cybercrime and open- source intelligence, technical knowledge of investigation techniques, evidence and the functioning of the financial services industry and the financial sector laws will be an advantage. 

ANALYST – POLICY SUPPORT DEPARTMENT (Pretoria)

Purpose of the Job: 

To provide support and undertake research and analysis on trends in financial consumer behaviour, financial products and services, and financial sector policy matters such as financial inclusion. To disseminate information to relevant departments within the FSCA and participate in developing the regulatory and supervisory frameworks to support the achievement of the FSCA’s mandate, including ensuring better customer outcomes in the financial sector. The person appointed to this position will report to the Senior Specialist: Policy Support.

• Support the development and implementation of policy for the FSCA

CONTRACT MANAGEMENT SPECIALIST – ICT GOVERNANCE, RISK AND COMPLIANCE DEPARTMENT (Pretoria)

Purpose of the Job:

The ICT Contract Management Specialist will manage the contract lifecycle within the ICT services and cybersecurity domains. This role will focus on contract drafting, negotiation, formulation, and Service Provider Contract management, ensuring compliance with legal requirements, corporate governance, and risk mitigation. Central record keeping and updating of all ICT contracts.  Align to the South African contract laws, Public Finance Management Act (PFMA) regulations, and supply chain management processes, for ICT and cybersecurity-related contracts. The person appointed to this position will report to the Departmental Head: ICT Governance, Risk and Compliance. 


Key Performance Areas:

• Draft, review, and amend ICT contracts where required, (e.g. licensing agreements, procurement contracts).
• Act as the key contact and subject matter expert for all contract-related and tender activities. This includes negotiating contract terms, conditions,   modifications, penalties and incentives, while working with key stakeholders to ensure that their requirements are met. 
• Manage the contract execution process, resolving problems, mitigating delays, mediating disputes and escalating issues.
• Assist with the development and Service Level Agreements (SLAs), and be responsible for the final versions of requests for information.
• Establish ICT contract management objectives, procedures, templates and workflow processes for Service Provider contracts and deliverable schedules and   manage a contract register containing a database of all executed contracts.
• Ensure that the Service Provider(s) are compliant with FSCA’s internal rules and regulatory obligations.
• Evaluate Service Provider performance based on contract terms (e.g., quality of services, adherence to deadlines).
• Manage contract performance review meetings with key Service Providers to ensure delivery against objectives and contract budgets, develop regular reports   on contract milestones and performance, and inform internal customers, vendors and management of activities and progress through regular written and   verbal communication.
• Provide recommendations for improvements to processes, procedures, workflow and organizational structures for procurement plans and ICT contract   management.
• Establish clear processes for the involvement of supply chain and legal resources in the contracting life cycle.
• Resolve and/or recommend any Service Provider performance issues in a timely manner.
• Oversee the full lifecycle of contracts, from initiation and negotiation through execution, monitoring, and renewal/termination.
• Ensure timely renewal or termination of contracts to avoid service interruptions or unfavorable conditions.
• Coordinate with relevant departments to ensure smooth execution of contract lifecycle processes.
• Identify and assess risks associated with ICT contracts, including Service Provider reliability and contract obligations.
• Develop and implement risk mitigation strategies aligned to the ICT Risk portfolio.

Requirements

Bachelor’s degree in law with a specialisation in contract or commercial law, with a strong foundation in South African legal standards or a related discipline with at least 5 years’ working experience within an Information Technology (IT) environment. A 5 year’s minimum experience in IT contract management, particularly in cybersecurity and ICT services. Strong knowledge of the Public Finance Management Act (PFMA) and supply chain management practices in a government or corporate environment.  Proven ability to draft, negotiate, and manage IT and cybersecurity contracts with a focus on legal compliance and risk management. Purpose of the Job:

To provide first point of contact for IT services and assist clients with hardware and software related technical issues and to provide on-site or remote IT technical assistance including troubleshooting of IT issues. The person appointed to this position will report to the Infrastructure Manager.


Key Performance Areas:

• Manage the FSCA ICT service desk function as an entry point or single point of contact (SPOC) for business users.
• Respond to calls on ICT Call Centre telephone system.
• Log, categorise, prioritise and route service tickets on the ICT incident management platform.
• Respond to incidents and service requests and ensure that they are successfully finalised and update stakeholders accordingly. 
• Identify, analyse, troubleshoot and resolve computer problem affecting user’s ability to perform business functions.

SENIOR ANALYST : MARKET TRANSPARENCY AND RISK MANAGEMENT DEPARTMENT (Pretoria)

Purpose of the Job

To oversee the implementation and supervision of the regulatory framework for credit ratings agencies (“CRAs”) and financial benchmark administrators (“FBAs”). CRAs are primarily regulated and supervised in terms of the Credit Rating Services Act No. 24 of 2012 (“CRS Act”); and the regulations of financial benchmarks is currently under development. The person appointed to this position will be stationed in the Market Integrity and Decision Sciences Division and will report to the Senior Manager: Ratings and Indices.



Key Performance Areas

• Provide support in the implementing and administering of the CRS Act, Conduct Standard – Requirements relating to the provision of a benchmark and any   other subordinate legislation.
• Initiate and conduct routine market conduct on-site inspections of CRAs and FBA in terms of the Risk-Based Supervision approach.
• Review and recommend for approval or refusal of applications for licence, amendments, exemptions, and outsourcing arrangements for CRAs, and assist the   licencing division in the review of applications for license for FBAs. 
• Conduct relevant research to improve the standard of regulation in line with national and international developments and requirements.
• Participates in and contributes to discussions regarding possible regulatory and policy direction on the regulation and supervision of CRAs and FBAs.

The Markets, Issuers and Intermediaries Department of the FSCA is responsible for licensing and supervising market infrastructures (i.e exchanges) operating within the South African financial markets in terms of the Financial Markets Act, 2012 (Act no 19 of 2012). The department has oversight responsibilities over public markets, authorised users and issuers. The person appointed to this position will be stationed in the Market Integrity and Decision Sciences Division and will report to the Senior Manager: Public Markets, issuers and Authorised Users.

Key Performance Areas

• Assist in Identifying shortcomings and anomalies to the regulatory framework;
• Assist in proposing changes to the regulatory framework and assist the Department with the implementation of such changes;

To assist the department in ensuring that the approved authorised Financial Services Providers (FSPs) and their Compliance Officers complies with the Financial Advisory and Intermediary Services (FAIS) legislation. The person appointed to this position will report to the Manager.


Key Performance Areas:

• Monitor compliance with legislation to ensure sound and efficient Financial Services Providers and the protection of consumers;
• Analyse annual financial statements of Financial Services Providers to ensure that proper reporting standards and procedures have been followed;

Requirements

An LLB or B Com or B Tech with Accounting as major with at least 2 to 3 years relevant experience of financial services industry or compliance management. The candidate must have a good knowledge and exposure to the financial sector, a good understanding of the FAIS Act of 2002. Good knowledge and/or experience of the FAIS regulatory framework and understanding of the insurance or banking industry is essential.
