Job Profile:
- Provide legal advice to the municipality by drafting and providing legal opinions and advice, compilation of legislation and commenting on legislation and litigation
- Amend, drawing up and commenting on contracts and service level agreements
- Draft items under delegated powers to the relevant Committee, Council, Municipal Manager or the Deputy Director to ensure that legal obligations are met
- Draft and management of by-laws
- Preside independently and objectively over disciplinary hearings and ensure that proper procedures are applied
- Align and implement key legal requirements with respect to upholding the image and / or maintaining positive perceptions of the municipality
- The institution and / or defending of legal action on behalf of Council as instructed
- Provide a legal information service to Council and the municipality’s components
- Responsible to partake in Municipality’s Performance Management and Development Systems by guiding the employees to plan, manage and / or prioritize strategic operational outcomes accordingly in terms of the Municipal Staff Regulations
Requirements:
- A relevant 3-year tertiary qualification preferably a B-Degree in Law (LLB advantageous)
- 5 – 8 years relevant legal experience required
- The appointee will be required, as a condition of his/her appointment, to obtain the Minimum Municipal Competency Levels in the unit standards for each competency area within 18 months from the date of appointment, as regulated by the Local Government: Municipal Finance Management Act, 2003 (Act No 56 of 2003): Municipal Regulations on Minimum Competency Levels
- Computer Literacy: MS Office
- Valid Code B Driver’s licence
- Required to perform more complex legal functions independently with minimal supervision

DEPUTY DIRECTOR: LEGAL, RISK AND COMPLIANCE
Job Profile:
- Manage and deliver strategic, high-level legal services within the Office of the Municipal Manager to support the Council, Council structures, Mayoral Committee, the Municipal Manager, Senior Management, and Line Departments effectively and efficiently
- Provide strategic input to the Municipal Manager on long-term planning for the legal, risk, and compliance function to ensure the division effectively meets its operational needs, goals, and objectives
- Provide independent, strategic, and specialist legal and management support to the Municipal Manager, political office bearers (upon request), and Executive Directors by offering advice, recommendations, guidance, proposed actions, and executive legal support
- Oversee and manage staff utilization, productivity, and performance within the division to foster a positive work environment that supports motivation, enhances work-life balance, and ensures service delivery objectives are achieved
- Coordinate and oversee tasks related to personnel management, focusing on performance, productivity, and discipline to ensure human resource needs are addressed, objectives are achieved, and productivity and performance standards are met
- Identify, define and implement the immediate, short- and long-term managerial objectives and plans (3 to 5 years) associated with the provision of administrative support to divisions
- Manage the implementation of financial controls/procedures and providing information to support financial planning for the department to meet the objectives and to sustain quality and standards of service delivery
- Responsible for administration and support to ensure that legal procedures are understood, followed and adhered to
- Fully accountable and independently responsible for managing the flow of legal communications / advice / opinion / contracts / service level agreements and other legal documentation from / to the Cape Winelands District Municipality and / or other stakeholders
- Responsible for aligning with the broader legal services strategy, defining and implementing short-term plans, and ensuring adherence to current legal procedures and legislation including studying and interpreting legislation and communicating its impact on the Cape Winelands District Municipality
- Responsible and accountable for drafting policies and ensuring that it is aligned with the Council’s
requirements - Drafting, assisting, and guiding contract management, with full responsibility for ensuring legal compliance by independently providing timely, accurate, and high-quality legal advice
- Support and assist management in managing labour relations to promote effective institutional management and ensure fair labour practices and social justice within the municipality
- Attend meetings and provide appropriate legal input and sound legal advice to minimize risk and ensure legal compliance
- Effective management of legal administration and ensuring that it is in line with the strategic objectives of the municipality
- Ensure that the Systems of Delegations for Cape Winelands District Municipality are updated, legally
compliant and accurately implemented - Provide legal support to the processes of the Division: Supply Chain Management in terms of compliance with applicable legislative requirements
- Manage the restriction process of suppliers in terms of the Supply Chain Management Regulations and National Treasury’s General Conditions of Contract and ensuring high level of legal service to Council
- Responsible for ensuring that the municipality is in compliance with the Protection of Access to Information Act (Act No 2 of 2000)
- Encourage a legal framework for decision making, administration and drafting municipal by-laws within relevant legal frameworks
- Responsible for initiating internal appeal hearings and providing the public with a mechanism for reviewing municipal decisions, ensuring compliance with legislation and that all decisions are lawful, reasonable, and procedurally fair
- Manage the compliance status of Cape Winelands District Municipality and ensure that it complies with statutory compliance matters
- Promote risk mitigation by identifying early warning signs that may hinder organizational growth, through continuous monitoring, reporting, and evaluating the effectiveness of processes and protocols implemented to reduce identified risks
- Ensure that the municipality is compliant with legislation regarding property matters
- Promote and improve staff skills, performance and knowledge for innovative service delivery and business results
- Required to represent Council in labour management discussions, grievance hearings, disciplinary
hearings, counselling sessions, incapacity hearings, arbitrations and the Local Labour Forum, if and when required
Requirements:

ADVISOR: RISK AND COMPLIANCE
Job Profile:
- Develop and design effective and efficient risk measurement and monitoring tools for risk management systems and ensure that it aligns effectively between the Risk Management process and the strategic objective of CWDM
- Conduct regular risk assessments to identify key risk areas, implementing controls to mitigate these risks, and preventing actions that could harm the municipality by identifying and reducing exposure
- Review the municipality’s compliance with legislation and Council policies to prevent financial or
reputational loss resulting from non-compliance - Develop a communication plan to increase awareness and understanding of risk management strategies, supporting the implementation of effective practices that strengthen good governance and improve service delivery
- Coordinate specific procedures for implementing and executing risk management, ensuring that processes and practices are properly institutionalized and comply with the National Treasury Risk Management
Framework and relevant statutory regulations - Advocate for Enterprise Risk Management (ERM) by providing specialist expertise to help integrate risk management across the institution, ensuring that plans, strategies, procedures, systems, and controls effectively minimize the impact of risks faced by the municipality
- Manage the daily operation of the automated risk management system and execute the action plans in accordance with organisational directives
- Provide administrative and logistical support services related to the Fraud and Risk Management
Committee’s operations - Responsible to partake in Municipality’s Performance Management and Development Systems by guiding the employees to plan, manage and / or prioritize strategic operational outcomes accordingly in terms of the Municipal Staff Regulations
Requirements:
- A relevant 3-year tertiary qualification in Internal Audit or Auditing or related field
- 5 – 8 years’ relevant experience which includes 2 years of supervisory experience
- The appointee will be required, as a condition of his/her appointment, to obtain the Minimum Municipal Competency Levels in the unit standards for each competency area within 18 months from the date of appointment, as regulated by the Local Government: Municipal Finance Management Act, 2003 (Act No 56
of 2003): Municipal Regulations on Minimum Competency Levels - Computer Literacy: MS Office
- Valid Code B Driver’s licence
- Must be a Member of the Institute of Risk Management South Africa
- Performs the full range of Enterprise Risk Management activities within a functional area or more
- Have sufficient knowledge of COSO Framework and ISO 31000 Risk Management Standards
- Language proficiency in at least two of the three official languages of the Western Cape
- Communication skills, both verbal and written
