Position Purpose

To ensure that all entries in the accounting and tax fixed asset register is complete; accurate and valid and that it is reconciled to the general ledger.

Position Outputs

To process accounting entries in the FAR to results in a complete; accurate; valid IFRS compliant Fixed Asset Register and tax asset register Preparation of a monthly asset roll forward schedule Preparation of monthly acquisition and disposal summaries with supporting documentation Capturing impairment and fair value adjustments to ensure completeness, accuracy and validity Capturing/updating SAP data for the annual asset verification Preparation of the reconciliation of FAR to GL.

Position Purpose

The implementation of the supply chain – contract management throughout 
Transnet Property (TP) ensuring that the contract management policy, contract 
management Standard Operating Procedure (SOP) and contract management 
Control Framework is properly embedded in alignment with the expectations of the 
Transnet Board, and Group Exco.
In light of the approval of the contract management SOP granted by the Transnet

Position Outputs

Pre-contracts planning Draft Contract documents for Suppliers. Manage development of contracts i.e. attending all demand stages of procurement events. Create a long-term and medium-term plan for the creation of contracts for specific businesses ensuring that resources are sufficient and competent to support TP’s requirements. Assist in the management of procurement contracts. Keep track of communication between TP and Suppliers. Ensure that Transnet’s contract management norms and standards are aligned to best practice. Ensure convenient access to historic and all current versions of contracts including start dates, end dates and contract values is established / updating the Contracts Register. Create a database of lessons learnt to aid future planning processes.
Ensure that risk is minimised through effectively dealing with poor contract performance thus eliminating unethical practices within Transnet. Assist in drafting procedures on how TP can best manage their supply chain and transversal contracts through the use of SAP CLM ensuring that all contracts are loaded on SAP CLM system. Ensure contracts are approved in accordance with the Delegation of Authority framework. Prepare for Contract kick-off meetings and Monthly status meetings. Ensure Contract Management meeting minutes are taken accurately, approved on time and made accessible as required. Work closely with all stakeholders e.g. Strategic Sourcing, All End-Users, Legal Department, to expedite contract development. Assist in the embedment of Supplier Relationship Management within TP.
Contractual analyses Develop Contract Management solutions by applying advanced contractual modelling techniques to enable effective Contract Management and support Contract Management initiatives. Conduct contract analysis to ensure effective governance and compliance. Conduct general and specialist Contract Management benchmarking activities. Support business End-Users in applying the contract management principles to ensure compliance.
Contract Management Reporting Report on a monthly basis, on all contracts activities and attend monthly contracts review meetings with business. Complete and issue a Contract Review Record and ensure that relevant issues from the review are fed back into the procurement process. Undertake compliance action where appropriate. Interpret contract provisions and review contracts for accuracy and changes prior to award and renewal.
Guide and assist in the contract amendment process ensuring compliance with SOPs and Delegation of Authority. Manage and monitor internal and external audit processes for information related to the Contract Management KPIs. Compile contract management reports for submission to Management. Prepare the Top List Contracts Report.
Stakeholder Management: Work closely with all stakeholders e.g. Sourcing, Facilities Management, Real Estate, Finance – to expedite contract development and management processes. Work closely with the Contracts Manager to resolve disputes around operational issues with key Suppliers. Develop a system to gather and communicate supplier performance information to critical stakeholders. Demonstrate continuous effort to improve operations, decrease turnaround times, streamline work processes, and work cooperatively and jointly to provide quality seamless customer service. Advise End-Users on courses of action related to claims and contractor non performance. Create responses to non-routine correspondence and handle special assignments and problems.
SAP Module enhancements Assists with SAP CLM Loading of Contract documentation.

Qualifications and Experience

Bachelor’s degree (preferably Legal or Construction or Supply Chain Management or related qualification) is required. 5 years relevant experience in a large enterprise, preferably with 1 yr supervisory or specialist experience.

Position Purpose

Draft pleadings, notices, affidavits and all related legal instruments.
9. Give instructions to attorneys and counsel during the litigation and arbitration hearing process, review and provide feedback on all pleadings and documents drafted by external law firms and Counsel, assist with preparing the necessary pleadings and documents as well as management of invoices and legal budget. 10. Conduct legal research in the course of litigation cases management and preparation. 11. Participate in and contribute to all steps of the litigation process with external legal providers and other related stakeholders. 12. Develop, manage and maintain relationships with key stakeholders.
13. Actively manage and contain litigation costs. 14. Draft of legal opinions and provision of legal advice where required. 15. Develop processes and procedures for accurate legal provisioning and contingent liability reporting. 16. Implement litigation processes and procedures, including digital solutions, to ensure efficient litigation case management and reporting.
17. Identify internal control weaknesses or failures revealed by litigation and notify the business thereof. 18. Position Purpose

• Provide strategic leadership and guidance in the management and delivery of Commercial Legal services across Transnet Rail Infrastructure Manager, to protect the organisation for undue liability and exposure to risk.

Mimimise TRIM’s exposure to litigation risks arising from mediocre or deficient contract management practices by developing strategies and governance mechanisms to address business risks. 7. Provide thought leadership and legal advice on all legal aspects which may have an impact on procurement. 8. Review and provide accurate, expert and specialist legal advice and opinions on all Construction Law, Commercial contracting and related matters.
9. Provide advice on legal aspects of sales, marketing and new business opportunities. 10. Manage commercial arbitrations, including preparing and drafting claims for arbitrations and assisting external counsel where necessary. 11. Review and draft all relevant agreements/documents pertaining to Legal-Commercial and ensure that they are in compliance with all statutory and/or legal requirements. 12. Transnet Rail Infrastructure Manager (TRIM) invites suitable, unemployed South African graduates between the ages of 18-35 to apply for a two-year graduate development programme, within various functional areas to be provided with both the institutionalised knowledge and on-the-job training to help you build a solid work experience to increase prospects of employability. The programme is structured and mentored for twenty-four months and candidates progress is assessed after every six months to ensure that the programme meets the expectations of both the candidate and TRIM.
