Purpose of Job
The Senior Specialist Data Privacy and Sustainability Reporting will support Sasol with Privacy related matters, as well as Sustainability/environmental, social and corporate governance (ESG) reporting matters across Sasol, as well as ensuring compliance with rapidly evolving governing laws, regulations and global standards to help Sasol to deliver against its sustainability/ESG goals and targets. The role will include collaboration with various stakeholders within Sasol.
Recruitment Description / Key Accountabilities
- supporting the Group Data Privacy Office in the establishment, creation, development and maintenance of international data privacy best practice controls for the Sasol Group.
- guiding the various legal entities within the Operating Model Entity/ies (OME/s) with the appropriate implementation of developed data privacy controls.
- as an expert with the major country specific privacy laws, for example General Data Protection Regulation (GDPR) and South African Protection of Personal Information Act (POPIA) etc., provide privacy law advisory services to Sasol in all the major Sasol regions as required.
- provision of legal expertise on Sasol’s sustainability/ESG reporting/disclosure framework with respect to mandatory and voluntary sustainability/ESG related reporting requirements/initiatives, including EU’s Corporate Sustainability Directive (CSRD), Corporate Sustainability Due Diligence Directive (CS3D) and proposed U.S. Securities Exchange Commission’s rules on climate disclosures.
- providing legal advice on emerging legal developments, laws, rules, regulations and best disclosure practices related to sustainability/ESG issues/programs globally, and keeping abreast and ensuring compliance with the relevant Stock Exchange requirements.
- developing sustainability/ESG reporting expertise and capabilities within Securities and Governance Laws function.
- developing and delivering training and capacity building for key legal and business personnel with regard to sustainability/ESG legal risks.
- reviewing sustainability/ESG disclosures including external sustainability/ESG reports, communications and regulatory disclosures.
- developing and assisting with preparation of the relevant Sustainability/ESG reports; and
- providing guidance on sustainability governance processes and procedures and attending to due diligence matters.
Job Outputs
- Assist with the development and maintenance of Data Privacy strategy, policies, standards and procedures.
- Design and implement of Data Privacy controls in business processes.
- Support the OMEs in maintaining data inventories and data flow maps as necessary.
- Lead investigations into complaints about data privacy breaches of the applicable act and undertake reporting/remedial action as required. Maintain a log of any incidents and remedial recommendations and actions.
- Interpret and provide guidance to the Group Data Privacy Office on forthcoming and actual changes to relevant legislation on global privacy matters.
- Provide Privacy advisory services within the Sasol Group of Companies, as required.
- Provide privacy awareness and training initiatives.
- Develop and maintain privacy management tools.
- Ensure that privacy risk assessments are carried out for all new systems, projects or workflows.
- Interpret the legal requirements of corporate sustainability laws such as CSRD and CS3D or the German Supply Chain Due Diligence Act with regards to reporting requirements.
- Assist in designing sustainability/ESG reporting Key Performance Areas and Key Performance Indicators for Sasol Legal Entities and Operating Model Entities, especially in Germany and Italy.
- Provide day-to-day legal advice on corporate sustainability/ESG reporting matters.
- Identify the data requirements in terms of the European Standards for Sustainability Reporting (ESRS) and any other similar requirements within the jurisdictions that Sasol operates; and
Formal Education and Experience
Minimum LLB or equivalent law degree from an accredited tertiary institution with 9 years’ of experience
Specific experience and skills required
- 9 years of relevant experience in law firm, corporate legal practice and skills in corporate governance, regulatory experience and/or compliance
- relevant privacy experience
- relevant sustainability/ESG reporting and governance knowledge and/or experience with stock exchange disclosures and reporting
Certification and Professional Membership
- Certified Privacy Practitioner recommended (for example International Association of Privacy Practitioners)
- Admitted Attorney or equivalent qualification
