Purpose of the Job: The RAF Attorney: High Court is responsible for all High Court matters within the Fund and to offer litigation services accordingly. This role will also be responsible to perform a range of tax services including tax bill of costs in compliance with South African laws and regulations.
Key Performance Areas
Policy Review and Implementation
- Contribute to the development and implementation of departmental policy, procedures and processes.
- Keep up to date with effective policy and practice execution strategies.
Preparation and Research on Related Litigation Matters
- Conduct research that will provide information in preparation for all matters for trial.
- Consult with client departments/ representatives, and witnesses for instructions and documentation for cases to be presented in Court.
- Draft pleadings to provide clear motivation/justification on a particular position about the case.
Mediation Process
- All required steps regarding the mediation process, as governed by the amendment to the rules of court, are to be taken.
- Upon conclusion of the mediation, parties shall inform Registrar and all other parties by a notice that Mediation is completed.
- Parties & Mediator must within 5 days of completion of mediation issue a joint minute indicating.
Represent the Road Accident Fund on all third party claims related litigation matters
- Attend court appearances in all allocated third-party litigation matters.
- Ensure file administration from opening to the conclusion of a legal case including adherence to trial dates.
- Handle appearances at courts, tribunals, mediation hearings and inquiries.
- Coordinate administrative legal actions to ensure compliance.
- Approve instructions to appoint and instruct expert witnesses.
Settle non-litigious matters before they are set down for trial
- Block consultation, early assessment of files, and early instructions to experts and assessors.
- Approve requests to appoint and instruct assessors and expert witnesses.
- Recommend a settlement.
Provision of legal advice to RAF
- Provide legal advice on arising legal matters and contracts.
- Provide well-researched legal advice on matters impacting the organisation.
- Conduct legal research and prepare legal opinions.
Taxation
- Deliver a full range of tax services in compliance with laws and regulations.
- Build relationships and interact with clients to provide consulting and expertise in tax services.
- Provide innovative tax planning and review complex income tax returns
Reporting
- Prepare and submit regulation reports as and when required to provide progress updates and/or inform management decisions.

Purpose of the role:The MANAGER is responsible for the overall proceedings of the litigation portion of an MVA claim. They must also handle budgeting and review legal documents. He/she must manage a team working under them and advise them on effective trial strategy, legal questioning and litigation management. He/she must also have significant input in the hiring and terminating of employees. Additionally, He/she must review the overall litigation department of a region and make improvements to help it function more effectively. On occasion He/ She will need to attend court settlements. He/she may also help RAF to avoid protracted litigation process before it gets to an advanced stage. In such cases, the Senior Manager: Claims should be consulted on decisions that could potentially give rise to more legal costs. He/she can help the region evaluate the risk that the decision entails and determine the chances of the potential cost in the event litigation is pursued to its fullest. He/she can also provide guidance, counseling and advice on other decisions the region could make or ways in which the RAF could prevent or minimize the chances of litigation.

- In conjunction with litigation staff, attend consultations with RAF Attorneys in preparing for a Court Hearing and ensure all necessary follow up action is taken, as required by the Litigation Manager.
Ensure provision of an estimate of the anticipated cost of each significant aspect of the litigated claim
- Oversee and ensure detailed bill reviews to implement sound litigation management and expense control.
- Ensures gathering and considering of relevant information (including detailed confidential documetation such as police, court, medical and personnel records), consider with regard to instructing experts in a range of medical specialities.
Ensure investigation, evaluation and settlement of claims, applying technical knowledge and human relations skills to effect fair and prompt disposal of cases and to contribute to the organisational strategy on reduction of legal and claims costs
- Oversees and ensures that investigations are done timely and in terms of relevant court rules. This includes but not limited to:
- Identification of and taking statements of witnesses.
- Accident reconstruction (including photographs, diagrams, measurements, etc.)
- Production of documents.
- Purchase order/contracts/lease agreements.
- Internal statements, memos and correspondence.
- Inspections, etc.
- Blueprints, if applicable.
Verify and analyse data used in settling claims to ensure that claims are valid and that settlements are made according to RAF practices and procedures
- Ensure all information regarding litigated cases is recorded on the RAF’s claims database.
- Maintain claim files such as records of settled claims and an inventory of claims requiring detailed analysis.
- In conjunction with the Litigation Manager, developm, implemnt and review processes, systems, policies and procedures for the effective and efficient management of all correspondence relating to medico-legal requests.
Prepare and anlyse reports to be submitted as and when required by the Litigation Manager and Management Committes
- Ensure maintenance of the content on the claims database in accordance with RAF policy and procedure. Provision of regular and ad-hoc reporting to Senior Managers and RAF Management Committees.
- Submit analysed reports on newly litigated claims and keep the Litigation Manager informed, on a regular basis, of the progress of the investigation of these cases.
Contribute to the RAF’s overall corporate governance processes to assure efficient and effective administration of litigated claims and compliance, RAF values and code of conduct including PFMA
- Review individually, at least annually, the performance of immediate subordinate staff, provide guidance on personal development requirements and advise on and initiate, where appropriate, further trainings, as required by the Litigation Manager.
