DEPARTMENTAL HEAD SUPERVISION : FINANCIAL ADVISERS AND INTERMEDIARIES (Pretoria)

Description

Purpose of the Job:

The Departmental Head will be responsible for leading the development, implementation and monitoring of a departmental strategy and operational plan aligned with the strategic priorities of the Financial Sector Conduct Authority (FSCA) and the Conduct of Business Supervision (COBS) Division. The incumbent will also develop and implement an annual plan for supervising Financial Services Providers (FSPs), including Crypto Asset Service Providers (CASPs), in line with the FSCA’s risk-based supervisory framework and overall COBS supervisory plan. The person appointed to this position will work collaboratively with other Departmental Heads in the COBS Division and report to the relevant Deputy Commissioner.

Requirements:

An appropriate Post-Graduate qualification in finance, commerce, accounting, audit, law, risk management, actuarial or related discipline with at least 12 years’ experience at a financial institution, supervisory agency or audit firm specialising in financial sector regulatory risk management, 8 of which must be in a management or senior management role, which included managing large and diverse teams. Deep understanding of the financial sector, various business models employed and the wide range of existing and emerging conduct risk issues, with a specific focus on the provision of financial advice, intermediation and distribution. The candidate must demonstrate the ability to lead inspection, supervisory, compliance monitoring or risk management teams in a financial services regulatory environment. In-depth knowledge of the financial sector regulatory landscape, including ongoing regulatory reforms, the Financial Sector Regulation (FSR) Act, No. 9 of 2017, the Financial Advisory and Intermediary Services (FAIS) Act, No. 37 of 2002 and developments relating to the future Conduct of Financial Institutions (COFI) framework is required.

Key Performance Areas:

  • Manage onsite and offsite supervision activities;
  • Oversee statutory reporting submitted by regulated entities;
  • Update supervisory colleges on key issues and emerging conduct of business trends to the extent applicable to the mandate of the FSCA;
  • Recommend regulatory action for material contraventions of applicable legislation;
  • Engage internal and external stakeholders to set and achieve strategic objectives including leading and co- ordination of supervisory activities and thematic projects;
  • Contribute to the FSCA’s broader transition to an outcomes-focused approach to supervision;
  • Represent the COBS Division at relevant FSCA management and governance forums, including the Executive Committee (EXCO) and applicable EXCO sub-committees;
  • Represent the FSCA at various external forums, locally and internationally;
  • Prepare various supervisory and operational monthly, quarterly and annual update reports;
  • Prepare and manage the department’s annual strategic and business plans as well as the budget;
  • Manage the performance and development of the team effectively and efficiently, and promote progressive talent and career development of staff; and
  • Perform such other tasks necessary or desirable to enhance the performance of the department and/or Division.

SPECIALIST ANALYST – RETIREMENT FUNDS CONDUCT SUPERVISION DEPARTMENT (Pretoria)

Description

Purpose of the Job: 

To monitor compliance by retirement funds, benefit administrators and other persons responsible for the collection of contributions due to retirement funds to ensure compliance by them with all laws to which they are subject to, including, but not limited to, the Pension Funds Act and regulations, notices and directives issued in terms of that act, the rules of the funds, and the conditions in terms of which administrators and contributions collectors are authorised to render services to retirement funds.  

To investigate market conduct issues and assist in the implementation of risk-based supervision;
To analyse financial statements submitted by benefit administrators and make recommendations;
To make recommendations to the boards and principal officers of retirement funds, and representatives of fund administrators and others on ways to remedy problems identified;
To fulfill such other duties as may reasonably be assigned from time to time, taking into account the nature of his or her work, skills and experience and the needs of the FSCA; and
The person appointed to this position will report to the Manager.


Key Performance Areas:

  • Assist with the development of a regulatory framework and monitor compliance with legislation to ensure sound and efficient retirement fund industry and the protection of consumers;
  • Analyse annual financial statements of retirement fund benefit administratorsto ensure that proper reporting standards and procedures have been followed;
  • Liaise with retirement funds and retirement fund benefit administratorson issues of non-compliance;
  • Support team members with the analysis of regulatory returns and planning for on-site inspections;
  • Assist the Manager with projects and ad hoc tasks;
  • Manage and perform on-site inspections on retirement funds and retirement benefit administrators to ensure compliance with pension fund legislation and produce reports on findings or observations; and
  • Liaise with industry stakeholders and manage complex complaints and queries and provide technical guidance to retirement funds, benefit administrators and team members.

Requirements

A Bachelor of Commerce or Law degree with at least 5 year’s relevant working experience in the retirement funds industry. The candidate must have knowledge and exposure to the retirement fund benefit administration industry and an understanding of section 13B of the Pension Funds Act, 1956 and Board Notice 24 of 2002. Experience in the analysis of financial statements and a degree with an Accounting major will be an added advantage

Description

The Financial Services Consumer Education Foundation (Foundation) invites nominations for the services of three Trustees to serve on its Board on a non-executive basis. The Foundation is an independent Trust, established by the Financial Sector Conduct Authority (FSCA) with the sole purpose of promoting and funding financial consumer education initiatives that are developed, implemented, and managed by the Consumer Education Department (CED) of the FSCA. The aim of these initiatives is to increase the level of financial literacy of both existing and potential consumers of financial products and services.

Trustees should ideally have a minimum of 5 years’ experience and skills/knowledge in:

  • Community engagement
  • Consumer Financial Education
  • Financial services (Chartered Accountant, Consumer Education Specialist, Audit and Risk)
  • Behavioural economist/Social Development
  • Audit and project management
  • Stakeholder engagement/donor relations

  • Supporting the FSCA in meeting its mandate of providing and promoting financial education in SouthAfrica.

Purpose of the Job

The Markets, Issuers and Intermediaries Department of the FSCA is responsible for licensing and supervising market infrastructures (i.e exchanges) operating within the South African financial markets in terms of the Financial Markets Act, 2012 (Act no 19 of 2012). The department has oversight responsibilities over public markets, authorised users and issuers. The person appointed to this position will be stationed in the Market Integrity and Decision Sciences Division and will report to the Senior Manager: Public Markets, Issuers and Authorised Users.

Key Performance Areas

  • Assist in Identifying shortcomings and anomalies to the regulatory framework;
  • Assist in proposing changes to the regulatory framework and assist the Department with the implementation of such changes;
  • Assist to develop and maintain an effective and efficient supervisory framework within the context of the approved legislation;
  • Assist with the monitoring of compliance with the provisions of the Financial Markets Act and subordinate legislation;
  • Assist to plan and conduct inspections;
  • Liaise with and render appropriate regulatory guidance to stakeholders after consultation with the Manager;

Requirements

A business, economics, accounting, finance or Mathematics degree or similar with 2 to 5 years of experience in the financial sector and/or the regulatory environment within the financial services industry. INFORMATION GOVERNANCE MANAGER : (GRC) ICT GOVERNANCE, RISK AND COMPLIANCE (Pretoria)

Purpose of the Job:

The Information Governance Manager will manage and oversee the daily operations of the Information Governance (IG) portfolio within the ICT Division. This role ensures the effective implementation and management of IG  policies and practices, and supports the organisation’s compliance with data protection regulations. The person appointed to this position will report to the Departmental Head: ICT Governance, Risk and Compliance.

Minimum Experience:

Experience in developing and implementing governance frameworks across large or complex organizations, ideally with a focus on data regulations (e.g., DAMA-DMBOK, POPIA, ECTA).  Hands-on experience in data governance tools and technologies, as well as managing information assets, data quality, and data lifecycle management processes.  Experience in regulatory compliance and managing audits related to IG, cybersecurity, and data protection.  Experience collaborating with cross-functional teams and leading initiatives related to data stewardship, risk management, and data quality.

Key Performance Areas:

  • Improve and maintain the IG framework, aligning with industry standards (e.g., ISO 27001, ISO 38500, DAMA-DMBOK, POPIA).
  • Maintain policies and procedures related to data governance, data security, and data privacy.
  • Coordinate with key divisions to improve the IG framework across the organisation.
  • Regularly review and update governance policies to reflect evolving regulatory requirements, business needs, and technological advancements.
  • Ensure that roles and responsibilities for data ownership, custodianship, and stewardship are clearly defined and communicated.
  • Develop and implement data and information protection impact assessments (DPIAs) for new projects or systems.
  • Conduct regular assessments to ensure compliance with data regulations and internal policies.
  • Coordinate training programs to raise awareness of data and information management and compliance requirements across the organisation.
  • Act as the primary point of contact for data-related inquiries and investigations from external or internal auditors.
  • Identify and assess risks associated with the organisation’s information assets and governance practices.
  • Develop risk mitigation strategies to reduce the likelihood and impact of data breaches or governance failures.
  • Implement and manage data and information risk assessment processes, including the classification of data based on its sensitivity and risk level.
  • Compile reports on IG risks and mitigation efforts for senior management and relevant committees.
  • Ensure that data stewards are appointed and trained across departments to manage data accuracy and integrity.
  • Improve processes for data quality monitoring, including regular data audits and exception reporting.

  • Mature data lifecycle management practices to ensure the appropriate retention, archival, and deletion of data.
